Contract Risk Reviews & Risk Management

A thorough understanding of your contract, its processes, and its risks helps set a better platform to manage the project. Our team uses its prior litigation and management experience to help you better understand the contract requirements, and then design processes that meet those requirements and enhance your project success.

Risk management starts with an accurate identification of the risks, but without processes and tools to help prevent and manage those risks, they too often become a reality. We work with your team to identify and manage the risks unique to your project, consistently driving the team toward proactive solutions for prevention and limitation of those risks. If and when they occur, we will help you understand how to proceed to reduce effects to your project and organization.

Scheduling and Planning

We work with your team to understand your plan to complete the project, and then develop a schedule that not only memorializes that plan, but better enables the team to make valuable time-management decisions throughout the project life cycle. We also provide schedule update and analysis services that improve your schedule performance assessments, and allow your project management teams to focus on what is most important to achieve the project’s time-based objectives.

Project Controls and Cost Management

Of course, cost management is important. Our team specializes in not only understanding your project cost and revenue objectives, but also how to better control and manage the operations that drive those costs and revenues. We work with your team to gain an in-depth understanding of your operational processes, and then use that information to improve project forecasting, financial performance, and, if needed, recovery for costs being expended that are outside of your control.

Construction projects change, so you need to have a team prepared to properly resolve those changes. Time Impact and Time Extension Analysis

Time is one of the most expensive components of any job, and projects never go as initially planned. Project management costs increase with time, and management of your field resources and material supply chain flexes as project performance and requirements change. Our team will analyze the specific circumstances of your change or issue, and then analyze the project schedule, critical path, and other time-related aspects of your project to accurately quantify the effect of those issues so they can be accurately priced and recovered. Once those items are accurately quantified, we will provide a time extension analysis that meets the contract requirements, is supported by the project facts, and places your company in a better position for recovery.

Productivity and Inefficiency Analysis

The efficient use of resources is key to any project’s operational and financial success. Our experience enables us to understand the risks to your resource productivity and efficiency, and places you in a better position to identify when those items change. We will work with your team to identify productivity losses, provide causation and root-cause analysis, and determine how to improve performance or quantify the effects of productivity issues already incurred.

Expert Witness Testimony

We provide expert witness testimony on scheduling, delays, acceleration, inefficiency or loss of productivity, and the additional costs that result from these items.

Schedule and Delay Analysis

Our team has performed schedule and delay analyses for over 20 years, and have used or critiqued the following analysis methods:

Cost and Damage Analysis

Once the various impacts are accurately quantified, the next step is to determine the additional costs, or damages, resulting from those impacts.

The additional costs incurred could be increased field office costs, home office costs, liquidated damages, or other increased costs resulting from delays to the overall project duration. Delays to the overall project duration may also result in increased field resource costs, owner’s representation costs, supervisory and inspection costs, equipment rental costs, and many other types of increased costs.

Likewise, there could be tremendous additional costs that also result from non-critical delays such as extended labor and equipment costs, increased inspection costs, idle labor and equipment costs, escalation costs, subsistence costs, subcontractor cost increases, and many other types of increased costs.

The same can happen with inefficiency costs, but you get the point. Once we understand the unique impacts to your project, our team has the experience to accurately identify and quantify the additional costs that arise out of those situations.

Dispute Resolution

Our team has provided analysis, presentations, or testimony to resolve disputes in the following dispute resolution forums:

  • Court and Arbitration proceedings

  • Dispute Resolution Boards (DRBs)
  • Partnering or Executive Level Briefings
  • Project-level Briefings

Seeking a resolution at the project level requires a different strategy than presenting to a DRB or mediator. Likewise, communicating to an arbitration panel can be quite different from trying to communicate with a judge or a panel of jurors. The point is that our hands-on experience allows us to understand the unique nature of each forum, customize the communication protocols and tools at each level, and then effectively present our analysis and information in an objective manner.

Critique of Other Analyses and Claims

Our independent, objective review of other organizations’ work and experts’ work product have provided substantial benefit to our clients. Whether the organization desires an outside “red team” review of a claim before it is submitted or an attorney desires an expert to critique the analysis provided by another organization, our experience in the nuanced details of these analyses provides a unique value to our clients.
